LEGAL & BILLING
Refund Policy
Clear terms for digital downloads, memberships, cancellations and legally required refunds.
Effective date: 28 October 2026
Version: 1.0
1. Scope and operating principles
DiviHarbor is a membership-based library of downloadable third-party Divi and WordPress plugins and related digital resources, operated by Mioo Design in Belgium (enterprise number 0700.444.126; VAT BE 0700.444.126). This Refund Policy applies to Annual, Founders Lifetime and any other Lifetime membership offered through our website.
Our memberships provide digital access; no physical products are shipped. This Policy explains our commercial no-refund approach, the rules for cancelling renewals, and the mandatory legal remedies that may apply. It must be read together with the membership description, checkout information and our Terms and Conditions. If a mandatory consumer right conflicts with this Policy, that right takes precedence.
2. Our standard no-refund policy
Our standard rule is that we do not offer voluntary refunds for a change of mind after a member has started downloading digital resources. Downloaded files cannot be returned in the way physical goods can. This includes situations where a member no longer needs a plugin, changes project plans or decides not to use a download, provided the relevant product and service were supplied as described.
This is a commercial policy, not a waiver of statutory consumer rights. A request received before any digital delivery or download will be assessed in accordance with the applicable legal withdrawal rules and the nature of the purchased membership. We do not advertise an unconditional money-back or trial guarantee.
3. Digital downloads and the right of withdrawal
Consumers in the European Union and European Economic Area generally have a statutory 14-day withdrawal period for eligible distance contracts. For qualifying digital content not supplied on a physical medium, that right may be lost once performance begins, but only where all applicable legal conditions are met: the consumer has given prior express consent to delivery beginning during the withdrawal period, has expressly acknowledged the resulting loss of the right of withdrawal, and has received the required confirmation on a durable medium.
Where these requirements have not been met, or the legal exception does not apply to the transaction, DiviHarbor will not rely on the digital-content exception to deny a valid withdrawal. Merely describing a purchase as digital, granting account access, or placing a generic reference to this Policy in the checkout is not by itself sufficient to remove a statutory right.
4. Withdrawal rights for membership services
A membership may include an ongoing digital service, such as continued library access, changing collections, account functionality or recurring provision of downloads. The legal classification of such a service may differ from that of a specific standalone digital file. Downloading one plugin does not automatically eliminate every right to withdraw from the entire membership.
Where a statutory withdrawal right applies to a digital service or other service contract, eligible consumers may exercise it within the applicable period (normally 14 days after conclusion of the contract). If the consumer expressly requested that service performance begin during that period, a lawful proportionate charge for performance already supplied may apply if the conditions for charging it are satisfied. No deduction will be made where applicable law prohibits one.
These provisions apply in particular to consumers protected by EU/EEA law; consumers elsewhere retain the mandatory rights applicable to them.
5. Annual Memberships and renewals
An Annual Membership is billed for its stated annual period and may renew automatically if that is shown at checkout. Unless a legal withdrawal, refund or cancellation right requires otherwise, payments for a period already started are not refundable solely because a member chooses to stop using the library or has downloaded plugins.
Members may prevent a future renewal by cancelling automatic renewal before the next charge through an available account-management option or by contacting support. Cancellation normally prevents further renewal charges and leaves access available until the end of the paid period, subject to the membership terms and any applicable law. Cancelling does not automatically reverse an earlier payment. A charge made in error, a statutory withdrawal or a mandatory legal remedy will be handled separately.
6. Founders and other Lifetime Memberships
Founders Lifetime and any standard Lifetime Membership are one-time purchases with the access rights and duration described in the applicable membership offer and Terms and Conditions; they are not automatically renewable annual subscriptions.
We do not offer a voluntary change-of-mind refund for a Lifetime purchase after downloadable content has been accessed or downloaded. This does not exclude statutory withdrawal rights where applicable, including where the transaction constitutes a continuing digital service rather than solely the supply of qualifying digital content, or any mandatory remedies for non-conformity or non-delivery.
The meaning and limits of “Lifetime”, the scope of access and treatment of third-party plugins must be explained in the membership terms and product information.
7. When a refund or other remedy may be required
Nothing in this Policy excludes a consumer's mandatory legal rights where a digital product or service is not supplied, materially not as described, or non-conforming under applicable law. Where required, we will first provide an appropriate lawful remedy, such as restoring access or bringing the digital content or service into conformity within a reasonable time and without charge or significant inconvenience. Where the relevant conditions are met, the consumer may be entitled to a proportionate price reduction, termination and/or reimbursement.
We will also review and correct verified duplicate charges, payment-processing errors and other cases where repayment is required by law. The applicable statutory rights are not defeated by a previous download, a no-refund notice or the use of third-party software. Consumers in Belgium and the EU enjoy mandatory conformity protections for digital content and digital services.
8. Requests not normally eligible for a voluntary refund
Unless a mandatory legal right or an exception described above applies, voluntary refunds are generally not provided for: changing your mind after downloading; deciding not to use a plugin; choosing the wrong membership; failing to cancel an upcoming annual renewal before the charge; expecting a feature, vendor licence or compatibility that was clearly and accurately excluded or disclosed before purchase; or technical issues caused solely by an unsupported setup that is outside the stated product description and our obligations.
This paragraph does not excuse an inaccurate product description, misleading compatibility information, failure to supply purchased access, or a defect for which DiviHarbor is legally responsible.
9. Technical problems and support
If you cannot access your membership, download an available file or complete a download, please contact our support team with the affected order and plugin details. We will investigate access and delivery problems and, where appropriate, attempt to restore the contracted functionality.
DiviHarbor distributes third-party plugins and our standard support concerns membership access and download or installation access issues. The scope of any vendor-specific support, updates, licence activation, compatibility or third-party developer services is governed by the applicable product information and membership terms. These commercial support limits do not remove mandatory conformity rights.
10. Cancellation and existing downloads
Ending or not renewing an Annual Membership normally ends future access to membership-only downloads and future library benefits at the end of the relevant paid period, subject to the Terms and Conditions and applicable law. A Lifetime Membership has no recurring annual renewal to cancel.
Termination of membership access does not, by itself, change any independent rights that the customer already holds under the licence of a legitimately obtained third-party plugin, including rights granted by applicable open-source licences. This Refund Policy does not impose new licence-activation requirements or retroactively rewrite third-party software licences.
11. How to request a refund or withdraw
For a refund claim, payment error, statutory withdrawal or cancellation request, use the contact/support form on our website or the available support function in My Account. Include your account email address, order number (if known), purchase date, the membership or plugin concerned and a brief description of your request. We may request information reasonably necessary to verify your identity, ownership of the order or the issue.
If you are exercising a statutory right of withdrawal, you may communicate your unequivocal decision through the same contact channel. You do not have to give a reason where the law grants an unconditional withdrawal right. We will assess the request according to the legal classification and circumstances of your purchase. You may also use any mandatory model withdrawal form where applicable.
12. Refund processing, legal rights and updates
Where a refund is owed, we normally return it using the original payment method unless the customer expressly agrees otherwise and the law permits it. A valid statutory consumer withdrawal will be reimbursed within the applicable legal time limit, normally within 14 days after we are informed of the withdrawal, subject to the legal rules governing the transaction. Bank and card-provider posting times may vary. Lawfully permitted deductions for performance already supplied will be explained where relevant.
This Policy applies to consumers and business purchasers, but some withdrawal protections are specific to consumers. Business customers receive any mandatory rights applicable to them and the contractual rights stated in our Terms and Conditions. No clause of this Policy removes a right that cannot legally be excluded.
